Today I want to share my experience with a Builder in Noida, Gautam Budh Nagar. Actually I had booked a #ready_to_move flat on 19th September 2016 from Builder APS GROUP , registered name is #APSVisionHomesPrivateLimited ,Noida, registered office address is A-81, First Floor , Sector 65, Noida . The Directors of Company is Pankaj Kumar or Pankaj Chaudhary or Pankaj Chikara (There is so many titles of him) , Sandeep Chikara and three others joined in June 2017.So let’s come to the point ,so my possession date was 30th January 2017. Deal was on 30%(Booking Amount) :70% (On Registry Date ). so i had paid 30% amount to Builder and demanded for Builder Buyer Agreement. But Mr. Pankaj said that There is no need of Builder Buyer Agreement. you will get your flat in 2 months and if i will fail to deliver then i will pay 6k per month to you. Finally possession date were came which was 30th January 2017, i ask for a Possession from Builder ,then he told me that sir demonetization breaks our work so it’s one month delay in possession. again February came ,then again i ask for possession , again new excuse that ‘Ek week main shift kara raha hu bas’. then i was in doubt that something going went wrong. so i had started writing email for everything , day to day discussions, phone call discussions, status of flat and also demanded BBA on email. but from the month of Mar 2017 , He didn’t picked my call , never replied on my any email also didn’t told the date of registry. also whenever i asked him for registry then he threatening us every time, sometimes he threatening us from his lawyer and sometimes he showed us his Felony(Gundagardi). Suddenly he called to my father in month of July and told that “Uncle ji registry Parso hain ,aap aa jao”. My father came here and called him for the confirmation of time to reach registry office. But he denied for Registry and told that “äbhi 4-5 din aur lagenge”. it’s happened 4-5 times when he called for registry and denied everytime. Finally he called and told us that 21st September is the final date of registry. one more thing i forgot to told you that he taken registry amount from us . so we were reached at registry office on 21st September 2017 . then he told us that “Jao apna stamp purchase kar lo” but we already paid registry amount to him . so we said that we had already paid to you our registry amount. But he said that “Main to abhi paise nahi laaya mujhe yaad nahi raha abhi aap kara lo ,main sham ko office chalkar apko cheque de dunga”. then we collects money from colleagues and purchase stamp and submitted registry fee. after registry we came to his office and wait for him. but he delayed again and again and finally he called again at 8:30 PM and told us that “Main abhi late ho jaunga , aap kal 11 baje akar apna cheque le jao”. so my father again reached his office and wait for him but he didn’t came his office also didn’t received my father’s call. then i regularly tried to contact him and he picked up my call . then i ask for a cheque and also ask the reason of why he didn’t pick up call the he said that “Main apni car ki service kara raha hu aap kal Neelesh (Neelesh sharma is a Manager )se site office se le lena”. so again i reached at his site office in Shahberi. Then Neelesh ask for my what’s app number and send some pics . so there is my booking form and some calculations of my payments on plain paper and asking for GST from me . even he didn’t have any GST Number. Also i am not liable for GST ,so i denied for GST and ask for my money back. so his Manager Neelesh told us that “GST amount pay karo aur tumhara koi rupaya nahi milega aur ek baat dimag main bitha lo ki ye log legally bahut strong hain to seedhe se paise de do aur rehna to tumhe yahi hain”. many times he threatening to kill me . So for safer side i prepare a complaint application and given in Bisrakh Thana, G. B. Nagar and Phase -3 Thana, Noida ,G. B. Nagar. also registry my application to SSP, DM, MYogiAdityanath through Post.and no action taken till now against builder. i had also raised complaint on Jan-sunwai app many times but result is zero. if anything happened with me or any person of my family then APS VISION HOMES will be responsible.

Finally we shifted in Flat and he cuts our light . also he captures all Electricity house in Bisnuli. when i went there then line man told me that “Builder se letter head par likha kar lao”. i told him that it’s a free hold property and also there is clearly mentioned in my registry that Electricity and water connection’s responsibility of buyer. builder is not responsible for any connection. But There is new rules created by Builder that he takes 20k from Buyer and provide Electricity connection. so finally i complaint of Electricity house ,Bisnuli by calling on toll free number. then finally i got the connection and still waiting for Sealing Report. But he regularly threatening us and didn’t returned my money back. One positive point is that i never given him any rupee in cash . i had paid all amount online and DD.
So below are some key points if you are buying a property :
* Firstly Clear the status of property (Freehold or under Authority) also takes khasra and khatoni from Tehsil
*Price deal(BSP or FSP)
* See the old booking form,BBA copy and also Registry copy
* also try to take BBA on the BBA date ,otherwise didn’t give any money to builder
